Minutes of the Meeting of the Rush Township Board of Supervisors

The meeting of the Rush Township Board of Supervisors was called to order by Supervisor Shawn Gilbert at 7 o’clock p.m. Those in attendance were Supervisor Robert Leibensperger, Supervisor Jeaninne Motroni, and Secretary/Treasurer Darlene Fenstermacher.

 

New Business

A motion was made by Supervisor Robert Leibensperger to Adjourn Old Board. Supervisor Gilbert seconded the motion.

 

A motion was made by Supervisor Jeaninne Motroni to appoint temporary Chairman – Shawn Gilbert. Supervisor Robert Leibensperger seconded the motion. All voted yes.

 

A motion was made by Supervisor Jeaninne Motroni to appoint temporary Secretary  – Robert Leibensperger. Chairman Shawn Gilbert seconded the motion. All voted yes.

 

A motion was made to Re-Organize the Board of Supervisors for 2012:

1. Nominate Shawn Gilbert Chairman for 2012. Robert Leibensperger nominated.  Jeaninne Motroni seconded. All voted yes.

2. Nominate Robert Leibensperger Vice Chairman for 2012. Shawn Gilbert nominated. All voted yes.

3. Motion to appoint Darlene Fenstermacher as the full-time Secretary/Treasurer for 2012 at the salary of $13.50 per year. Jeaninne Motroni nominated. Shawn Gilbert seconded. All voted yes.

Public Comment

Marion wanted to know why we are paying bills – Robert Leibensperger to pay bills up to date for 2011.

New Business

Motion was made by Supervisor Jeaninne Motroni to appoint Chris Riedlinger as Solicitor for 2012 for the Board of Supervisors at $100.00 per hour. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Chairman Gilbert to appoint Solicitor for 2012 for the Planning Commission at $120.00 per hour – (Peter Fagan). Vice-Chairman Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Chairman Gilbert to appoint Solicitor for 2012 for the Planning Commission at $85 per hour. (Burk & Burk). Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made to appoint solicitor for 2012 for the Rush Township Auditors. All voted yes.

 

Motion was made to appoint banks to be named depositor for 2012. Mauch Chunk Trust and Sovereign Bank. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made to appoint Arro Consulting as Zoning and Code Enforcement Officer as needed. (rate schedule Exhibit A) Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Chairman Gilbert to appoint Arro Consulting as the engineering firm for 2012 on an as needed basis (rate schedule Exhibit A). Supervisor Jeaninne Motroni seconded. Ms. Fenstermacher polled the Board. Vice-Chairman Robert Leibensperger declined.

 

Motion to appoint Engineer and/or Consultant for 2012 for the Planning Commission. Arro Consulting ( Rate schedule Exhibit A). Supervisor Jeaninne Motroni seconded. Ms. Fenstermacher polled the Board. Vice-Chairman Robert Leibensperger declined.

 

Motion was made by Chairman Gilbert to appoint Comprehensive Inspection Agency as Township Uniform Construction Code Inspector and Building Code Official – pursuant to attached fee schedule (rate schedule Exhibit B). Vice- Chairman Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Chairman Gilbert to set compensation for each Planning Commission member at $20 per meeting. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Chairman Gilbert to set compensation for each Zoning Hearing Board member at $10 per meeting. Vice- Chairman Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Chairman Gilbert to set compensation for each Township Auditor at $10 per hour. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Vice-Chairman Robert Leibensperger to appoint Sewage Code Enforcement Officer for 2012. – (William Brior $40.00 per hour.) Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Vice-Chairman Robert Leibensperger to appoint alternate Sewage Code Enforcement Officer for 2012 – (Bruce Dobash). Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Supervisor Motroni to appoint the Chairman of the Rush Township Planning Commission to serve as the township representative for the Region Planning Board. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Vice-Chairman Robert Leibensperger to adopt Resolution 2012-01 setting the fee schedule for 2012 for the sewage enforcement officer. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion to re-appoint the following road crew workers and rates for 2012 as follows:

Dennis Rupert as full-time Equipment Operator/CDL Truck Driver/Laborer at $16.90 per hour. Vice-Chairman Robert Leibensperger nominated. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All voted yes.

Elden Neifert as fill time Equipment Operator/Laborer at $15.00 per hour. Supervisor Motroni nominated. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

Laborer/Part time $10.00 per hour. Seasonal CDL Truck Driver $14.00 per hour & Non CDL Truch Driver $12.00 per hour. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion was made by Vice-Chairman Robert Leibensperger that benefits for full-time Township employees are as follows for 2012: paid Vacation – (Currently) After one year and on the employee’s anniversary date – 5 days, 4 to 9 years – 8 days, 10 to 17 years – 13 days, 18+ years – 15 days, New full-time employees must complete a six month new hire probationary period with the option to extend up to one year. All full time employees will be given medical insurance and paid holidays after the 90 day probationary period. 6 Paid Holidays (Currently) New Year’s – Memorial Day – 4th of July – Labor Day – Thanksgiving Day – Christmas Day; 2 Personal Days (cannot be carried over); Employer/Employee continuing Pension Plan; Work clothes and a $75.00 allowance for work shoes for the Road Crew. Vice-Chairman Robert Leibensperger nominated. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All voted yes.

 

Motion made by Vice-Chairman Robert Leibensperger to re-appoint police officers and rates for 2012 as follows:

Duane Frederick as full-time police sergeant at $21.28 per hour. Vice-Chairman Robert Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All voted yes.

Corey Herring as full-time police officer at $16.18 per hour. Supervisor Motroni motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. Vice-Chairman Robert Leibensperger declined.

Adam Sinton as full-time police officer at $16.18 per hour. Chairman Gilbert motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. Vice-Chairman Robert Leibensperger declined.

Carl Bachart as part-time police officer at $12.00 per hour. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

Richard Bekesy as part-time police officer at $13.25 per hour. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

Scott Cramer as part-time police officer at $13.25 per hour. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

Ryan Rehatchek as part-time police officer at $13.25 per hour. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

Richard Sinton as part-time police officer at $12.00 per hour. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

Peter Wysochansky as part- time police officer at $13.25 per hour. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

New hire Part Time Police Officer at $12.00 per hour and $13.25 after probationary period of one year. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion that the Board of Supervisors appoints the following list of names for the Hometown Fire Co. and Quakake Volunteer Fire Co. as Township Fire Police for 2012. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion that the Treasurer be authorized to pay payroll every other week. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to set the Treasurer’s Bond limits (3 million dollars). Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion that the Chairman and Secretary/Treasurer be authorized to sign the recap sheet and bond for the Tax Collector when due. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion that the Board of Supervisors be authorized to attend the State Convention in Hershey, PA. May 9th – May 12th, 2012 and authorize mileage, room, and food allowance ($50.00 per day) for 3 days to those attending. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to name Shawn Gilbert as the voting delegate and Jeaninne Motroni as the alternate voting delegate for the State Convention in Hershey, PA. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion that elect officials to be authorized to attend the Schuylkill County Convention and pay them as permitted by the Second Class Township code. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to appoint one registered elected to serve as Chairman of the Vacancy Board for 2012 – Ted Hafer. Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to set Township reimbursement rate for mileage for 2012 at $0.55 cents per mile. Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to appoint a resident representative to the Eastern Schuylkill Recreation Commission for one year term – Robert Leibensperger. Supervisor Motroni motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to appoint an alternative resident representative to the Eastern Schuylkill Recreation Commission for one year term – Jeaninne Motroni. Vice-Chairman Robert Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to appoint a representative Robert Leibensperger and alternate Shaun Gilbert to attend the Noth Schuylkill Landfill Association meetings. Supervisor Motroni motioned. Vice-Chairman Leipensberger seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to set the meeting dates and times for 2012 to the 3rd Thursday of each month at 7 p.m. except for the month of January. Supervisor Motroni motioned. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to adopt Resolution 2012-002 (signatures for bank accounts).  Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to adopt Resolution 2012-03 setting the garbage collection and disposal fees. Supervisor Motroni motioned. Vice-Chairman Robert Leibensperger seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to adopt Resolution for 2012-04 setting the sewer fees for Hometown. Vice-Chairman Robert Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. Supervisor Motroni declined.

 

Motion to adopt Resolution 2012-05 setting the sewer fees for Lake Hauto. Vice-Chairman Robert Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. Supervisor Motroni declined.

 

Motion to adopt Resolution 2012-06 appointing the TCC Voting delegates as follows: Primary Voting Delegate: Robert Leibensperber – First Alternate Voting Delegate: Shawn Gilbert – Second Alternate Voting Delegate: Jeaninne Motroni. Robert Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to appoint the Alcohol/Drug-Free Workplace Supervisor – Duane Frederick. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion to use the Times News as the newspaper for the township. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.

 

Motion for George Gerhard to be the computer consulting firm for the township. Chairman Gilbert motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. Vice-Chairman Robert Leibensperger declined.

 

Motion for Precision Design to be the consulting firm for the township’s website. Vice-Chairman Robert Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the Board. All said yes.
