Minutes of the Meeting of the Rush Township Board of Supervisors

The meeting of the Rush Township Board of Supervisors was called to order by Supervisor Shawn Gilbert at 7 o’clock p.m. Those in attendance were Supervisor Robert Leibensperger, Supervisor Jeaninne Motroni, and Secretary/Treasurer Darlene Fenstermacher.

Public Comment

Dan Metzger – The supervisors should consider getting a sound system so everyone can hear what is going no.

Harry Eisley – Spoke about cleaning up around the pump station by his backyard and how people used it for dumping

Joe Shamonsky – When is the line going to be drawn on what public can do on township property

Charlie Shamonsky – Trucks using Meadow Ave and Wyoming Street should have no parking signs added

William Boyer – Asked about paying employees for holidays when they were laid off. He also asked about the last payment on the Fortunado property.

 

Minutes of Previous Meeting – January 3, 2012 Reorganization & Regular – February 16, 2012 special meeting. Ms. Fenstermacher polled the board. All voted yes.

 

Treasurer’s Reports for December and January – Supervisor Jeaninne Motroni motioned. Vice-Chairman Leibensperger seconded. Ms. Fenstermacher polled the board. All voted yes.

 

Approval of Current Township and Sewer Bills Through February 16, 2012 – Vice-Chairman Leibensperger motioned. Supervisor Jeaninne Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

Municipal Reports – Vice-Chairman Leibensperger motioned. Ms. Fenstermacher polled the board. All voted yes.

Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

Attorney’s Business – Executive session held on January 24, 2012 – Executive session held today February 16, 2012.

 

Any doing any type of work or clean up in the township are doing it as volunteers. If they are injured in any way the Township will not be held liable.

 

Auditors duties: First mandatory duty of the auditors is the power to audit, settle, and adjust the accounts for elected or appointed officials of the township. Second mandatory duty of auditors is to determine the compensation for the current year for supervisors employed by the township. Discretionary duty of making audits of dockets, transcripts, and other officials records of the local District Justice to determine the amount of fines and costs paid over or due to the township.

 

Old Business

 

  1. Motion to remove Jeaninne Motroni as resident representative for the Eastern Schuylkill Recreation Commission. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

  1. Motion to appoint Joseph Pinkey as resident representative for the Eastern Schuylkill Recreation Commission. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

  1. Motion to remove Jeaninne Motroni as Road Master. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

  1. Motion to appoint Shawn Gilbert as Road Master. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

New Business

A. Motion to allow the High Mountain Dirt Riders to hold the “Shotgun Enduro Race” on Sunday, June 17, 2012 using roads in the township. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

B. Motion to approve Resolution #2012-08 setting UCC permit fee schedule. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

C. Following the public hearing that took place immediately prior to this evening’s meeting, we have before us Resolution #2012-09 to approve the transfer of Retail Restaurant Liquor License Number R-17922 from Monberger, Inc. of Shenandoah to Reese Bowling Centers, Inc., doing business as Sparetime Lounge at 17 Tide Road, Rush Township, Schuylkill County, Pennsylvania. I therefore ask for a motion to approve said Resolution. Chairman Gilbert motioned. Vice-Chairman Leibensperger moved. Ms. Fenstermacher polled the board. All voted yes.

 

D. Motion to allow our solicitor to sign any stipulations resolving tax assessment appeals where the Township is not a party to the litigation, the parties to the litigation have worked out a stipulation resolving the case, and the judge to which the case is assigned requires all interested taxing entities to sign the stipulation whether or not they are parties to the case. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

E. Motion to hire Christopher Huegel as a full-time road department employee at the rate of $15.00 per hour, with a one-year probation period which includes obtaining his CDL license within 3 months of hire date which is February 20, 2012. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All voted yes.

 

F. Motion to hire Michael Zimmerman as a full-time road department employee at the rate of $15.00 per hour, with a one year probation period. Michael currently holds his CDL license. Starting date of February 20, 2012. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. Supervisor Motroni voted no.

 

G. Motion to hire Kevin Ruby as a part-time police officer at the rate of $12.00 per hour. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. Chairman Gilbert declined. Vice-Chairman Leibensperger and Supervisor Motroni voted yes.

 

H. Motion for Elden Neifert to attend LTAP course on March 6, 2012 at the Carbon County Emergency Management Services Building from 8:30am to 12:00pm. Vice- Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All voted yes.

 

I. Motion to deposit the yearly funds of $1,500.00 received from the Lamar Company to the Rush Township Recreation Fund, earmarked for Ryan Park. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All said yes.

 

J. Motion to rescind motion to deposit the yearly funds of $1,500.00 received from the Lamar Company to the Rush Township Recreation Fund, earmarked for Ryan Park. Ms. Fenstermacher polled the board. Vice-Chairman Leibensperger declined. He feels the funds should stay in Recreation Fund. Supervisor Motroni and Chairman Gilbert votes yes.

 

K. Motion to change payroll companies from Optimal Employer Solutions to ADP payroll. Supervisor Motroni motioned. Vice-Chairman Leibensperger seconded. Ms. Fenstermacher polled the board. All said yes.

 

L. Motion to lease a time clock for use by all employyes of the Township from ADP Payroll. Supervisor Motroni motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. Vice-Chairman Leibensperger declined.

 

M. Motion to purchase a concrete/asphalt saw for the road department. Chairman Gilbert motioned. Vice-Chairman Leibensperger seconded. Ms. Fenstermacher polled the board. All said yes.

 

N. Motion to purchase a computer for the administrative office. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All said yes.

 

O. Motion to sell the 1995 Ford F350 Dump truck by bid as is, where is. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All said yes.

 

P. Motion to sell the 1995 Ford E350 Sewer van by bid as is, where is. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All said yes.

 

Q. Motion to sell the Sitrex by bid as is, where is. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All said yes.

 

R. Motion to sell the teeth for the front end loader by bid as is, where is. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All said yes.

 

S. Motion to sell plow for grader by bid as is, where is. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All said yes.

 

T. Motion to sell the Sweepster broom for scrap at highest rate. Vice-Chairman Leibensperger motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. All said yes.

 

U. Motion to pass S.O.P. for the police department. Vice-Chairman Leibensperger motioned. Supervisor Motroni seconded. Ms. Fenstermacher polled the board. All said yes.

 

V. Motion to purchase two AR-15’s for the police department. Supervisor Motroni motioned. Chairman Gilbert seconded. Ms. Fenstermacher polled the board. Vice-Chairman Leibensperger declined.

 

W. Motion to purchase a software package with the capability to perform sewer and trash billing. Supervisor Motroni motioned. Vice-Chairman Leibensperger seconded. Ms. Fenstermacher polled the board. All said yes.

 

Announcements

We would like to thank Pat Tracey, Jerry Tracey and William Boyer for folding the 2012 trash bills.
