MINUTES OF THE MEETING OF THE

RUSH TOWNSHIP BOARD OF SUPERVISORS

THURSDAY, FEBRUARY 21, 2013 7 P.M.

The Meeting of the Rush Township Board of Supervisors was called to order by Chairman Shawn Gilbert at 7 o’clock p.m. Those in attendance were Vice Chairman Robert Leibensperger, Supervisor Jeanine Motroni, Secretary/Treasurer Darlene Fenstermacher, William McMullen, Attorney Chris Riedlinger, and 8 residents.

2. PLEDGE OF ALLEGIANCE

3. PUBLIC COMMENT – Karen Parish provided information on a state grant for which Rush Township is applying.

Pat Tracey – Stated her concern for the homeowners living on Lincoln Drive.

Marion Lazur – Stated her concern for the homeowners living on Lincoln Drive.

4. POLICE REPORT – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

5. MINUTES OF PREVIOUS MEETING – JANUARY 7, REORG & REGULAR & MINUTES OF JANUARY 30, 2013 – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. Supervisor Motroni voted in favor with corrections.

6. TREASURERS REPORT – AS OF DECEMBER 31, 2012 & JANUARY 31, 2013 – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

7. APPROVAL OF CURRENT TOWNSHIP AND SEWER BILLS THRU FEBRUARY 28, 2013 – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

8. MUNICIPAL REPORTS (SEWER, ROAD, ARRO) – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

9. CORRESPONDENCE – Received information from Eastern Diversified, Pennsylvania Correctional Industries, and Estuary News. Received letters from the Pennsylvania Department of Conservation, Business Journal, PSATs Legal Defense, and Bulletin.

10. ATTORNEY’S BUSINESS – WHERE WE STAND WITH BOYER & BENESCH – Attorney Riedlinger stated that both parties have submitted statements. No further outstanding issue with Benesch.

11. OLD BUSINESS – Mr. Boyer rescinded his original resignation via letter. Open generator bid

12. NEW BUSINESS

A) MOTION TO APPOINT SHAWN GILBERT AS 2013 ROAD MASTER – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

B) MOTION T0 APPOINT ARRO CONSULTING AS CODE AND UCC ENFORCEMENT – Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

C) MOTION FOR JARRAD BERNITSKY TO ATTEND PUMP TRAINING AT SITE SPECIFIC ON FEBRUARY 27TH AND 28TH. PAY FOR 2 NIGHTS LODGING, MILAGE, REGULAR WAGES AND $40.00 FOOD ALLOWANCE. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

D) MOTION TO DEPOSIT LAMAR SIGN AND HOMETOWN FARMERS MARKET PAYMENTS INTO THE RECREATION BOARD FUND. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

E) MOTION FOR ELDEN NEIFERT TO ATTEND SPRING ROAD MAINTENANCE PRORAM ON MARCH 12, 2013 IN NESQUEHONING AND PAY REGULAR WAGE. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

F) MOTION TO ADOPT RESOLUTION 2013-08 AUTHORIZING, EMPOWERING AND DIRECTING THE PROPER OFFICERS OF THE GOVERNING BOARD TO APPOINT A LIAISON BETWEEN IT AND BERKHEIMER. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

G) MOTION TO ADOPT RESOLUTION 2013-09 APPOINTING FREY & CO. TO PERFORM THE 2012 AUDIT. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

H) MOTION TO CHANGE THE MARCH 21, 2013 MEETING DATE TO

MARCH 14, 2013. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

I)   MOTION TO ADOPT ORDINANCE #179 SCHEDULE OF ATTORNEY FEES       INCURRED IN THE COLLECTION OF ANY DELINQUENT ACCOUNT. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

J) MOTION TO ADVERTISE CHANGES TO BURNING ORDINANCE. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

K) MOTION TO ADVERTISE ORDINANCE FOR FIRE INSURANCE. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

L) MOTION TO PURCHASE WINTER WORK COATS FOR ROAD AND SEWER DEPARTMENT EMPLOYEES WITH REFELECTIVE STRIPS. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

13. SUPERVISORS COMMENT – THE TOWNSHIP IS WORKING IN

CONJUNCTION WITH NESQUEHONING AND TAMAQUA WATER

COMPANIES TO HAVE WATER SHUT OFF ON SEWER ACCOUNTS

WITH EXTREMELY DELINQUENT BALANCES UNTIL THEY ARE PAID.

RUSH TOWNSHIP HAS RECEIVED A $52,000 DOLLAR GRANT FOR      RECYCLING.

REPAIRS TO THE SEWER BUILDING

A SPRING NEWSLETTER WILL BE COMING OUT IN SOON

AN ELECTRONIC RECYCLING EVENT WILL BE HELD ON APRIL 20TH

FROM 9 AM TO 1 PM AT THE TOWNSHIP BUILDING

14. Motion to draw up plans for construction backsteps at sewer building. Motion made by Vice-Chairman Leibensperger. Motion seconded by Supervisor Motroni. Ms. Fenstermacher polled the Board. All voted yes.

15. ADJOURNMENT – Chairman Gilbert adjourned the meeting at 8:25pm.
