Minutes of the meeting of the Rush Township of Supervisors

A meeting was held at the Rush Township Municipal Building on September 18, 2014 at 7:00 o’clock pm. In attendance were Chairman Shawn Gilbert, Vice Chairman Robert Leibensperger, Supervisor Jeaninne Motroni, Secretary/Treasurer Denise Hope, Administrative Assistant Caitlin Whildin, Bill McMullen, 3 reporters, and 17 residents.

Chairman Gilbert called the meeting to order.

Pledge of Allegiance was recited.

PUBLIC COMMENT

1. Marion Lazur- questioned the status of Bob Heckman’s lawsuit, questioned what will be done with the old police radios, questioned if board members appointed regarding the new ordinance will be members of any other board

2. Joe Shamonsky Jr.- have questions regarding the new ordinance

3. Charlie Shamonsky- questioned why when they started the Meadow Avenue project they asked who was handicapped but the township didn’t make any accommodations for his wife, asked if Bill was notified that he called to report his wife being
handicapped, stated that a new police car should have been bought

4. Mr. Boyer- questioned why the township was working at the fire company that is considered private property but won’t fix the manhole in the alley by his house, asked why the supervisors are telling the road crew not to do anything for him

5. Joe Shamonsky- questioned the zoning laws, asked why zoning permits are issued, asked why Supervisor Motroni’s fence was added to the permit rather than being required to obtain a new one, asked what the proper height of a fence is within the
township, questioned what is going to be done about all this

6. Cathey Schimpf- asked why not reference the 2012 edition of the International Property Maintenance Code rather than the 2009 edition, stated that changing a “shall” to a “may” in an ordinance allows for selective enforcement

7. Lisa Price- asked for some of the alterations that have been made for the township to adopt this
ordinance

8. Mr. Murphy- questioned if what International wrote for the Property Maintenance Code will
ever be applied to this township’s ordinance

Police Report- Sergeant Duane Frederick read his report for the Month of August 2014. A motion was made by Vice Chairman Leibensperger to approve Sergeant Frederick’s reports. Supervisor Motroni seconded the motion. Mrs. Hope polled the board.
All members voted in favor of the motion, carried.

Minutes of Previous Meeting-A motion was made by Vice-Chairman Leibensperger to approve the previous meeting minutes of August 21, 2014. Supervisor Motroni seconded the motion. Mrs. Hope polled the board. All members voted in favor of
the motion, carried.

Treasurer’s Reports-A motion was made by Vice Chairman Leibensperger to approve the treasurer’s report as of August 31, 2014. Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of
the motion, carried.

Approval of Current Township and Sewer Bills thru August 31,2014

A motion was made by Vice-Chairman Leibensperger to approve all current township and sewer bills for August 2014.
Supervisor Motroni seconded the motion. Mrs. Hope polled the board. All members voted in favor of the motion, carried.

Approval of municipal reports (sewer, road, Arro, Prodesign)

A motion was made by Vice-Chairman Leibensperger to approve the municipal reports for August 2014. Supervisor Motroni seconded the motion. Mrs. Hope polled the Board. All members voted in favor of the motion, carried.

CORRESPONDENCE- PSATS, Ruth Steinart SPCA, Tamaqua Area Chamber of Commerce, PA Association of Housing. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in
favor of the motion, motion carried.

Attorney’s Business-

NEW BUSINESS-

A motion to approve advertisement for bids on a 2008 Ford Crown Victoria Police Car, with approximately 150,000 miles and does not include light bar, decals, or radio package. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to approve changing October’s monthly meeting from the 16th to the 27th at 7pm. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to approve Trick or Treat night for November 1st from 6pm to 9pm. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to approve Hometown Fire Police to direct traffic for the Marian home football games.

Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to approve Hometown Fire Police to help with Tamaqua’s Halloween Parade on Tuesday October 28th at 7 pm, with a rain date of Wednesday October 29th at 7pm. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to approve Ordinance No. 187, adopting the International Property Maintenance Code, as published by the International Code Council with certain alterations as the Maintenance Code of Rush Township. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to approve the purchase of four Motorola High Power Portable two-way radios from Greens Communications for a total of $15,602.00. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

A motion to purchase a trailer up to $2,000.00 for recyclables. Vice Chairman Leibensperger approved, Supervisor Motroni seconded the motion. Mrs. Hope polled the board, all members voted in favor of the motion, motion carried.

SUPERVISORS COMMENT

Properties are being posted for water shut off due to none payment of sewer bills. Those properties that the water can not be shut off on will be sent to Sheriff Sale. The delinquents for September are Garbage $56,126.90; Hometown Sewer $24,861.59;
Lake Hauto Sewer $3,549.52

Chairman Gilbert adjourned the meeting at 8:25pm.
