Minutes of the Meeting of the Rush Township Board of Supervisors

A meeting was held at the Rush Township Municipal Building on May 18, 2017 at 7:00 o’clock pm. In attendance were: Chairman Shawn Gilbert, Vice Chairman Robert Leibensperger, Supervisor Jeaninne Motroni, Treasurer/Secretary, Katie Orlick, Attorney, Chris Riedlinger and Bill McMullen. Chairman Shawn Gilbert called the meeting to order.

Pledge of Allegiance was recited.

Police Report Chief Lipsett’s police report for the month of April 2017 was read. A motion was made to approve the police report. Vice Chairman Leibensperger approved, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

Minutes of Previous Meeting – April 20, 2017 – A motion was made to approve the previous meeting minutes of April 20, 2017. Vice Chairman Leibensperger approved. Supervisor Motroni seconded the motion. Katie Orlick polled the board, all members voted in favor of the motion, motion carried.

Treasurer’s Report – A motion was made by Chairman Gilbert to approve the treasurer’s report as of May 2017. Vice Chairman Leibensperger approved the motion. Supervisor Motroni seconded the motion. Katie Orlick polled the board, all members voted in favor of the motion, motion carried.

Approval of current township and sewer bills thru May 17, 2017 – A motion was made by Chairman Gilbert to approve the municipal reports thru May 17, 2017. Vice Chairman Leibensperger approved. Supervisor Motroni seconded the motion. Katie Orlick polled the board, all members voted in favor of the motion, motion carried.

Approval of municipal reports (sewer, road, Arro, Prodesign) – A motion was made by Chairman Gilbert to approve the municipal reports for April 2017. Vice Chairman Leibensperger approved the motion. Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

Attorney’s Business – Chris mentioned to the Permanent Easement Agreement of William P. Webber tax parcel no. 25-22-0147.002, 25-21-0079.000, and 25-21-0078.000. Motion to allow Shawn to execute all documents pertaining to easement. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

NEW BUSINESS

1. Motion to approve Hometown Fire Police to assist Tamaqua Fire Police with their Memorial Day Parade on Monday, May 29, 2017. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

2. Motion to approve the purchase of 12 Grinder Pumps for Lake Hauto from Site-Specific Design, Inc for $21,044.04. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

3. Motion to accept Barry Ruch’s resignation, his last day being May 26, 2017. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

4. Motion to approve the Tamaqua Associates Subdivision Plan most recent revision being labeled Rush Township revision #2 without recognition of property line dispute. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

5. Motion to conditionally approve AutoZone Land Development Plan, (revision #2) without recognition of property line dispute. Condition of approval is the execution of an Improvements Agreement and posting of the required escrow for the proposed site improvements. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

6. Motion to approve the time extension for Tyrone & Janet Rarick for their preliminary Land Development, Lot 28 Tidewood East Industrial Park, Rarick’s Land Development. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

7. Motion for approval of Sewage Facility exemption mailer for the Work Land Development in the Tidewood East Industrial Park, Rarick’s Land Development. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

8. Motion to Ratify approval for the Land Development & Improvement & Maintenance Agreement between the Board & Versum Materials R & D Building. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

9. Motion to Adopt revisions to the Housing Rehabilitation policy for the Township’s Housing Rehabilitation Program. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

10. Motion to approve Leo Rodgers Module exemption conditioned on developer providing Narrative & Evidence of Reserving EDU for the project. DENIED until conditions are met to the satisfaction of the Board. Project narrative, engineering design, cost estimate approval – crossing stream & agreement followed easement EDU for NESJMA for system installation. Brior is to give Board what he already did. Then it comes back to Board for Approval. Cathy under the question: what happens if the system fails, there should be a plan in place? Shouldn’t he have a bond?

11. Motion to approve Change Order #1 of C & R Directional Boring, LLC for the Lincoln Drive Sanitary Sewer Project in the amount of $9,804.80. Vice Chairman Leibensperger approved the motion, Supervisor Motroni seconded. Katie Orlick polled the board. All members voted in favor of the motion, motion carried.

Public Comment

1. Mr. Boyer – asked if the Road Dept could cut the weeds on Walnut Street. Yes, they will get them during Spring Cleanup in June per Vice Chairman Leibensperger.
2. Charlie Shamonsky – If Meadow Avenue & Mariner are on snow emergency with Ordinance 165, what happens with the kids. Chairman Gilbert said that is the school’s issue.
3. Joe Shamonsky – What about Grove Street for snow emergency, Chairman Gilbert said that Grove St is traveled more than you think.

Chairman Gilbert adjourned the meeting at 8:15 p.m.
